These Terms and Conditions (“Terms”) govern your use of the Abbie’s Cigars website located at https://store.abbiescigars.com and all related services, including our SMS messaging program (collectively, the “Services”). By accessing our website, creating an account, making a purchase, or subscribing to any of our communications, you agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein.

If you do not agree to these Terms, you must not use the Services. We reserve the right to update or modify these Terms at any time. When changes are made, we will update the “Last Updated” date at the top of this page. Your continued use of the Services following any changes constitutes your acceptance of the updated Terms.

2. Age Requirement

Abbie’s Cigars sells tobacco products exclusively to individuals who are 21 years of age or older. This is a strict requirement under both federal law and our company policy.

By creating an account, placing an order, or subscribing to any of our communications, you represent and warrant that you are at least 21 years old. We collect your date of birth during account registration to verify your eligibility. If we determine or reasonably believe that you are under 21, your account will be terminated, any pending orders will be canceled, and you will be removed from all communication lists.

It is your responsibility to ensure that you comply with all applicable federal, state, and local laws regarding the purchase, possession, and use of tobacco products in your jurisdiction.

3. Account Registration

To make a purchase or access member benefits, you may create an account on our website. When registering, you agree to:

• Provide accurate, current, and complete information, including your legal name, valid email address, phone number, and date of birth.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the confidentiality of your login credentials and accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate any account at our sole discretion, including but not limited to accounts that contain inaccurate information, are involved in fraudulent activity, or violate these Terms.

4. Orders and Payment

All prices are listed in U.S. dollars. Payment is processed securely through our authorized payment processor at the time of purchase.

We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in pricing or product descriptions, suspected fraud, or inability to verify age or identity. If your order is canceled after payment, you will receive a full refund.

We also reserve the right to limit the quantity of any item purchased per person, per household, or per order.

5. Sales Tax

Applicable sales tax and excise taxes will be calculated and added to your order at checkout in accordance with federal, state, and local laws. Tax rates are based on the shipping destination of your order. If applicable taxes are not collected at the time of sale, it may be your responsibility to report and remit the appropriate taxes to your state or local tax authority.

6. Shipping

We currently ship within the United States via USPS. Shipping rates are calculated at checkout based on package weight and destination.

Please note the following:

• Delivery estimates are not guaranteed. Estimated delivery dates are provided as a convenience and may vary due to carrier delays, weather, or other factors beyond our control. Abbie’s Cigars is not responsible for carrier delays.
• Shipping restrictions apply. We cannot ship to all states or jurisdictions. Certain states prohibit or restrict the shipment of tobacco products. If your shipping address is in a restricted jurisdiction, your order will be canceled and refunded. It is your responsibility to know and comply with your local laws regarding the receipt of tobacco products by mail.
• Accurate shipping address. You are responsible for providing a correct and complete shipping address. Abbie’s Cigars is not responsible for orders shipped to incorrect addresses provided by the customer. Re-shipment of returned packages may be subject to additional shipping charges.
• Signature or age verification may be required. Some shipments may require an adult signature (21+) upon delivery in accordance with applicable laws.

7. Returns and Damaged Product Policy

All sales are final. Due to the nature of tobacco products and applicable health and safety regulations, we do not accept returns on opened or used products.

If your order arrives damaged, defective, or incorrect, you must contact us within 48 hours of delivery at scott@abbiestobaccoshop.com or (919) 964-2611. Please include:

• Your order number.
• A description of the issue.
• Photographs of the damaged or incorrect item(s) and packaging.

We will review your claim and, at our discretion, offer a replacement or store credit for verified damage or error. Refunds to the original payment method may be issued on a case-by-case basis.

Items that have been opened, used, stored improperly, or reported after the 48-hour window are not eligible for replacement or credit.

9. Pricing, Availability, and Typographical Errors

We make every effort to ensure that product descriptions, pricing, and availability information on our website are accurate. However, errors may occur. Abbie’s Cigars is not responsible for typographical errors, inaccuracies, or omissions in product descriptions, pricing, promotions, or offers.

We reserve the right to correct any errors and to cancel any orders placed based on inaccurate information, even after an order has been submitted or confirmed. If an item’s correct price is higher than the listed price, we will contact you before processing the order.

All promotions and offers are valid while supplies last unless otherwise stated.

Flavor and tasting note descriptions are subjective and provided for informational purposes only. Individual experiences may vary.
